If There Is A Joint Checking Account And 1 Party Wants Their Name Off The Account Or The Account Closed, Can They Do This Without The Other Person's Permission Or Signature?
Husband and wife have joint checking account that wife no longer uses. She wants to be removed from the account and the responsibility of the account.
If there is a joint account and one of the party doesn't want to use it then the account has to be closed. There is nothing like permission in this matter. Your companion doesn't want to use the account anymore and that is enough for the account to be dormant in future. You have to open a new account on your name.
The account must either be closed or you would need the written authorization from the person wishing to be removed. I'm pretty sure the party to be removed needs to physically present themselves at the bank in order to do so. At least that is the law currently in California.
Actually...nothing. It is like joint custody, you cant do anything without the other persons permission. How would you feel if the other person was trying to do the same thing?
