I Am Being Sued In Barrington, MA By A Lady Who Rented My Condo In Hawaii. I Live In California And Am Being Asked To Attend The Trial In Barrington, MA Small Claims Court. The Condo Was Rented Via A Hawaii Travel Agent . I Have Never Had Any Communication With This Lady. She Feels That The Agent Represents Me And I Am Therefore Liable For The 'misrepresentation'. She Is Asking For A Total Refund Of $2023 From Me Since She Found The Condo Unsatisfactory And Checked Out. How Can I Avoid This Trip To Mass And Yet Defend Myself ?

The law is that you could only sue the person who misrepresented you. But in a lot of contracts misrepresentation by the agent can be considered as misrepresentation by you. But if you can prove that you have no connection with the agent then he does not represent you.
