    My Landlord Has Not Fixed Anything For 8 Months And Know I Have Mold Building In My House. My Lease Says 24 Hour Maintance. Called Health Department Their Is No Law About Good Or Bad Mold.

    I fear for my health because I am on disability with a blood disease and bone disease. I mainly worry for my children my youngest is 6 months.

    The WORST thing you can do is stop paying your rent. You'll lose that battle REAL quick, mold or not, and end up evicted with no recourse. Forget the health department and any other 3rd party and definitely do not destroy their property. You need to get your correspondences with your landlord in writing. Your "verbal" complaints will mean nothing if it comes down to your word against theirs. Send them a certified letter or email spelling out how many times you have notified them of your mold problem and that you fear for the safety of your family. Send 1 every few days if there is no response. If after about a month you still have no results, you can pay almost any attorney about $40 to draft you a letter to them on their law firm letterhead spelling out your intentions to move out due to a lack of a "safe living environment." The landlord actually IS required by law to provide that for you (which means you could then turn around and take them to Landlord-Tennant court and get back your entire security deposit.) I recommend that you send them a certified letter immediately. Landlords will typically pick up what you are doing as soon as the delivery person makes them sign a legally binding confirmation of receipt and show up at your door ready to fix whatever you have going on.     I did that I had Equal Housing write up a letter on their letter head using lawyer form and I documanted all the calls and dates on then sent them the letter gave them four days and sent certified mail they did come out but didn't fix anything so I am going to write another letter saying they came out and this date but did nothing and send it certified.

      Pick up your phone and call your local health department.

      Mold is a health hazzard. Let the landlord get chased b the city or county.

      You could also consider filing a law suit against the landlord or stopping you monthly rent payments. However, if you do stop payments, I believe you need to deposit the rental money into its own account at the bank and do not put anything else in the account.

      One last suggestion, most areas of the country have at least one TV New program that claims to act on behalf of its customers. Here it is "10 On Your Side" see if they would be willing to work with you to get the problems fixed.

      Heck you can even hang a sign out your window asking viewers to call the landlord concerning the mold.

      Turn the heat way up, but be willing to work with the landlord and be careful that he just doesn't decide that you are not worth the effort and pull you lease.

      I called the health department their is no law regarding mold and what level of mold is concidered bad or okay. I also called City Hall and spoke to the department work placement and they gave me the run around. I e mailed pictures of all the damages to Elliot Davis NOTHING!

      You have done a very right thing to mold the building according to the best that suits your health. Health is wealth. Without health there is no joy in this world.

      At the time on agreement when you take the house on rent, you fix certain things about maintenance. If there is something mentioned in the agreement about how many times and when the landlord will fix things for you then he is bound to abide by it. Otherwise you can't complain.

      Hi zuhail it is in my lease they have 24 hour maintance service. My children have cracked window's since we moved in do to other children that are not supervised. It has been 8 months NOTHING

      call the local health department and report it. They will send the city to look at it. Then he will get notified to fix it. If he dont he will get find. If you have to move and he tryes to take you to court for rent moneys he will loose. Also you can sue him after this point for midical expenses and moving money. If you have lost anything do to the property damage he will have to replace that as well.

      I have called the health department their is no law about mold and what is good or bad mold. Everything that I have fixed I have keeped the reciept and toke that from the rent

      YOU SHOULD ASK YOUR LANDLORD ONCE TO FIX THE THINGS IN YOUR HOUSE IF HE OR SHE DOESN'T THEN YOU SHOULD FILE A LAWSUIT AGAINST THE LANDLORD

      Also be careful and try not to let you children around it. It does become air born and you could have serious health damage. I know you don't feel it's your responsibilities but you have to move now or kill it. Plain Bleach will kill it on contact. Put it in a bottle and spray directly on it.

      I was told by the health department if I ripe the rug up the landlord could sue me for destroying property. HOW IS THAT!!! I wanted to ripe it up and bleach it so I could kill the mold.

      If they dont do anything then tell them that you wont pay the rent until they fix whatever the needs to be fixed!!! if he kick you out then that when you pick up the phone and talk to the health department!
