    I Am Retired Age 53, Can I Withdraw My 401k Without Penalties?

    I am losing money and would like to do some other things. My 401k is with fidelity.

    This may not be true for your particular 401K, but many types of retirement accounts are not available to the individual until they reach the age of 59 w/o a penalty.  Like sy has mentioned, contact an attorney or a financial advisor who specializes in those types of things.

      It can be done, talk to a lawyer or accountant who specializes in this type of action. It has to do with life expectancy and drawing the money out in increments having to do with your expected lifetime.
