It is better to sue a person is the same province where he or she resides. There are three types of courts. The first is the Small Claims Court: the small claims courts deals with cases up to 1500 hundred pounds. The amount that you will be required to give your opponent if you lose the case is restricted to 70 pounds in this court. A solicitor may not be required in this court unless you file a case of physical injury. The Sheriff's clerk will explain the procedures to you.

The second type of court is the Summary Cause Court. This court deals with cases up to 5000 pounds. The third type of court is The Ordinary Court which deals with causes involving more than 5000 pounds. The procedures in an ordinary court are more complex and they also deal with divorce cases etc. You can sue someone in one of the above mentioned courts depending on your claim.
