    Can My Husband Get A Restrain Order Against His Brother?

    My husband and his brother are not in good terms, his brother took the children to places such as NY and Florida without my husband's knowledge and came to know that his brother left the under aged children in the hotel all by themselves while his brother and his friend went out to party. My husband's brother has been taking the children to family reunion and function to embarrasses my husband. His brother is influencing some family members that led to major misunderstanding in the families.

    I don't understand why you need a restraining order on this guy.  Can't you just refuse to let him take the children anywhere and tell him he is not welcome to come to your home at all?  Or is it a situation where the children referred to live with their mother and not with you and your husband?  It may be that a restraining order is not issued for something like this.  If so, you could certainly apply for a court order restricting his access to the children.  You must tell the court that he is endangering them if you know this to be true.  Sometimes people don't like to do this to a family member, but it sounds like this would be in the children's best interest.  You will probably need an attorney for this.  But if the kids are with you and your husband, just tell the brother not to come around again.  You might even put it in writing listing the reasons why.  Have the letter notarized (couple of bucks) and keep a copy for yourself AFTER it's notarized.  Send it to him registered so he has to sign for it and keep the receipt when you get it back from the post office.  If you can do it that way it may save you the cost of an attorney.  Of course if he violates your written request then there should not be any question that a restraining order could be obtained.  Sorry to be so darn wordy.  Good luck.
