My ex girl friend is on welfare and now I am being taken to child support even though I was paying giving her money orders for the support of my son.

Do you have copies of the payments? This is all you will need, and once child support is set up, they keep records for you. Once it has gone into effect, then you do not make the payments to her. If you have done this, then she might be in trouble with assistance, but then again they might look at is as an oversight. Depending on how long this has been going on for.
