Can A Tenant Hold Rent If Something Doesn't Get Fixed?

I told my landlord that my heater doesn't work and that the power company told me that it wasnt' my responsibility to fix the problem, it is up to the landlord. It's been over a month and my heater still isn't fixed. Can I hold rent until it is fixed?

    In most states in America, you're allowed to withhold some rent for problems with utilities. You also have the option of notifying the landlord that you are paying to have the problem fixed while deducting the cost of repair from the rent.

    Check with your local office for landlord/tenant issues.

      Well, you can't hold rent for this reason. But your claim to fix the heater is legitimate. You can sue her on that but such cases are not easy to deal with. You have to tell him politely about his responsibility or you should consult with your lawyer for this.

      An oral or a written request to fix the heater is all that is necessary. However, withing a reasonable time, if landlord has not acted upon it, for health reasons, you can have a repairman fix it. But pay the rent, less the cost of repair and include the repair invoice as proof.
