Can I Claim My Fiance As A Dependent And File Head Of Household?

    Hello all:

    I pulled this off of the IRS website, note the 2nd paragraph.  I don't know what "member of your household" is defined as, but at lest you know you can claim a non-relative...

    The person cannot be your qualifying child or the qualifying child of any other taxpayer.

    The person either (a) must be related to you in one of the ways listed under Relatives who do not have to live with you, ***or*** (b) must live with you all year as a member of your household  (and your relationship must not violate local law).

    The person's gross income for the year must be less than $3,500

    You must provide more than half of the person's total support for the year

      Nope. She is not a "Qualifying person" according to federal and state laws. She must be a blood relative. I can get you a chart of who all qualifies, if you like.

        Actually, Jonsjava's answer is incorrect.  If you go to the IRS site it will explain the test for a non relative to be claimed as a dependent.  She has to make less than 3400, you have to support her over 50%, etc etc.  If she's lived with you all year yes,,the one catch is their are like 7 states that say cohabitation is illegal, make sure you're not in one of those states.
