    Scotsmen generally have to retire at the age of 65, similar to their counterparts in England, Wales and Northern Ireland.
    However, in October 2006, important age discrimination legislation came into being.  This makes it unlawful now for a person to be discriminated against on the grounds of age.  
    Moreover, it grants a person the right to request not to retire.  This comes under the auspices of paragraph 5 of Schedule 6 to the Employment Equality (Age) Regulations 2006.
    A person who is expected to retire at the age of 65 now has to have 6 months notice fabout retirement rom their employer and they can then put in writing to their employer that they do not wish to do so.  The employer can then consider whether he wants that person to retire.  S/he can refuse the request if s/he chooses.
    There are some exceptions e.g. the fire service, police service etc.
