Do Sub Contractors Qualify For Overtime?
Does a sub contractors on 1099 and higher pay rate qualify for a overtime hourly rate ,if he puts in more than 40 hrs per week?

No. If he truly qualifies as a 1099 candidate and not as an employee then you only need pay the agreed upon rate. If you didn't contract on overtime you don't need to pay it.
