We Rent An Apartment In Oregon. The Managing Company Is Telling Us That We Cannot Smoke On Our Patio. Is This Legal? We Can Smoke On Our Front Porch But Not Our Back Patio?
 If it is a smoking complex, then the likelihood of smokers renting there is greater than a non-smoking complex and they should have foreseen the possibility of smokers, smoking. What does your rental contract state? If it makes no mention of not smoking on the patio, then I do not think they can enforce it retrospectively. |

The only legal way they can make you stop smoking there is if it were in the rental agreement that you signed. if its not there they have no legal right to tell you where and when you can light up |
