We Had A Flood In The Basement. Should We Be Paying Full Rent Every Month? What Are Our Rights?

We had 8 inches of sewer water in our basement 3 months ago. Landlord needs to put new insulation in and put the wood panels and floor trim back up. He has worked about an hour so far. Put wood panels back up with no insulation or floor trim. Is this legal to do? Isn't that a fire code violation? Should we still be paying full rent when we moved into a 3 bedroom and 2 bath, but now have 2 bedrooms and one bath without that finished basement before? And we have a baby coming any day now.

You need to go to the landlord tenant board and talk to them about it! They are there to help you with situations like this. If you give him a letter stating that you will be withholding the rent until it is fixed, then he will have to comply. You have to be able to prove though that you have the money, and keep it in the bank, so that you can show that you have it. Hope this helps, good luck.

No tell your land lord about it and get a free lawyer because he is responsible for the apt. To be livable.and if there was damage with the free lawyer then they will help you with it.
