    You can only get unemployment if you're fired.

      You have to have a very good reason for quitting (i.e., discrimination, harassment, hostile work environment, etc.)  You also have to be able to prove these instances you are claiming.  It would help tremendously if you have other employees (can be previous) that are willing to testify in your defense and back up these claims.

      I lost with this arguement - Now I want to appeal the EDD's decision - I quit for the reasons of harassment and hostile work envirnment etc.... There are past employees that have been harassed by the boss but not by the employee that I had the issue with.

        It was mutually decided by employee and employer, I resign my position after being on a performance plan for about 45 days.  How do I win if both the employer and myself agreed for me to render my termination.  I was also paid for additional six weeks after leaving the job January 9, 2009.  I was told to make my resignation effective February 23, 2009.

        I'm going to appeals court for EDD denying my claim, I took a voluntary resignation package because I was led to believe my position was going to be eliminated, and indeed it  has not been filled.  Company going centralized.  Do I have a chance?  Please reply.  Thank you.
