    My Tenants Signed A One Year Lease And Two Months Later Moved Out. Now They Want Their Deposit Back. Do I Have To Return Them?

    My tenants signed a one year lease and two months later moved out. They sent an email 2 days before the end of the month that they were moving out and for the first time complained about the house. Now they want their deposit back. Do I have to return it? They say if it is not returned they will go to the Housing Department.

    As a landlord, you should deduct the following from the security deposit and then must return it.

    1- If the tenant owe back rent or have damaged your apartment
    2- Storing or disposing of your unclaimed property.

    The tenant have to pay you the remaining rent of 10 months according to lease. Kindly read the lease agreement and law of your state to know the rules about security deposit.

      It's best to know your rights in these situations before they arise. Consult the Landlord and Tenant Board for your local area. The tenants are breaking a formal contract which is not without its own punishment. Though you may be required to return the deposit, they are in breach of contract and you do have legal rights. Get in touch with the right people immediately.
