Is It Legal To Tell An Employee That Their Physical Illness Is A Distraction In The Office?
Answers
This depends on which country that you are in of course. Some have more developed and sensitive laws on disability discrimination. However, in most countries you are going to get into a lot of trouble if you are not extremely careful. Why are you wanting to tell them this? For instance, if you wish to sack them you are going to need to speak to your company solicitor first, because this may bring the weight of the law down on you. Under the Disability Act of the UK, you would be liable to be sued, for instance, because you took this person on knowing that they were disabled and now you are choosing to discriminate against them.
If it is a distraction, you are responsible for helping that person. Perhaps there is something that you can do together with this person to make adjustments for the employee.
Be very careful.
