If My Childs Father Takes Her And Neither Of Us Have Custody What Can Be Done?

Answer Question

If neither of you have custody, the person having custody of the child has to call the police to put out an Amber alert. If a child is removed without the person who has custody permission, that is considered unlawful kidnapping. If this continues to happen after the police handles it, I am sure a judge would be more than happy to give a restraining order. Especially since neither of you have custody.  If your child's father is taking her because a relative of his has custody of your child or someone who does has custody of the child lets him take your child, you may need to call the agency that placed your child with whoever has custody, so your child will be placed with someone who will do the right thing by law and protect the child until custody is regained. That may ease your mind some.
