The property is under tenant's control and normally he is responsible for the damage to that property during that period. Then he is liable for the repairing the premises. Therefore the condition of the property should be mentioned clearly in the rental agreement.

    If the tenant makes any improvements in the property and landlord does not accept these improvements, then there is a possibility that tenant is required to recline or he has to pay the charges so that the property can be returned to its previous condition. In some states the tenant is required to notify before making any type of improvements. If you want to make any improvements then try to have a compensation agreement with the landlord if the improvements are not unwanted for him.

    In general landlord is responsible for the maintenance of the premises. He has to maintain the property in the proper condition. If there is some damage due to the improper condition the landlord has to compensate. The tenant should be aware of any conflicting right with the property holder in the neighborhood to avoid any kind of problems.
