If I Pay My Rent 12 Days Late While My Landlord Has A Month And A Half Security, Can I Be Evicted?

    No they have to file an eviction notice with the court...usually you have to be 30 days late b4 that..even if they file an eviction notice it wont go to court for probably another 3o days..and if your paid up then the judge will dismiss it. Hopefully your on good terms with your landlord...and a call from you telling them when you will pay will be all you need to do.

    If you breach your contract, fail to perform on your lease, by paying late, even though you have a damage deposit you can be evicted. Eviction papers filed takes 2 hours, you will be served by the sheriff within 4 days of filing. The court has to follow the law, and if it is found that you were in fact late, then that is a breach and the court will instruct the sheriff to remove you and your belongings, this takes about 12 days in a small city, 30 days in a bigger city, and you get to pay for it
