    After A Lease Expires, Who Is Responsible For The Subsequent Monthly Payments..the Tenant Or The Original Guarantor?

    My brother-in-law originally had his name on the lease of the apartment that his girlfriend lives in. The lease expired 5 months ago. She has not paid her rent. Is my brother-in-law responsible for the payments?

    If the lease is on your brother in law name then he is responsible to pay the rent, no matter who is living at the place. However, the lease should be active and lawful for the payment.

      Tenant is no more obliged to pay the rent of the property after the lease expires. The landlord has no right to charge the tenant any rent after the lease agreement has expired. Now the girl using the apartment is supposed to pay the rent for her stay.
