I Just Found Out The House I'm Renting Went Into Foreclosure And Will Be Sold In An Auction The Owner Is Nowhere To Be Found What Can I Do, What Are My Legal Rights?
I'm renting a house that went in foreclosure the owner doesn't return our calls. The house will be sold in an auction in two weeks.she rented the house knowing that she might loose the house but never told us anythingtv.
Well, I don't believe that you will automatically be thrown out, the property will have to be sold with you as a sitting tenant. I would check with a lawyer, but if the contract you signed is valid, then the landlords responsibilities now rest with the people now claiming to be the owners. If this is the case and the house is sold on, then the new owners will have to give you a reasonable amount of time to vacate the property if they want you out.
There is a very good side to this. If the above does apply, then it is likely that the property will fetch a very low price at auction as no one likes to take on a property with sitting tenants, especially if they have plans for it. Bearing this in mind, if you are in a position to do so, approach the bank/finance company concerned, it may well be that the rental you are paying is sufficient for them to consider doing a deal with you to take on a mortgage - find out first what they expect to get for it, if you can afford it make an offer (obviously lower than they want to start with) they may decide that what they save on the hassle and time involved would be a good deal to them.
