    Well, I can't advise regarding all of these questions. The way I understand it, since you can withdraw these 401K funds, they would be classified as an asset and be distributed between your credit cards and other outstanding bills.

    If you don't list particular debtors, they may be excluded by filing bankruptcy and maybe not. You would honestly be better off consulting a lawyer in your state who specializes in this.

    Each state has their own formula regarding whether you could retain your home, car etc. You can probably get a head start by searching your state and bankruptcy.
