What Are My Chances Of Winning A Custody Battle?

My ex and I have a joint residency order for 3 years but now my daughter is five it is no longer working. I need to move closer to my family and want my daughter to come and live with me and see her father during school holidays. She is very close with my current partner and I and she also has a younger sibling with whom she is very close, but my ex is not going to let her go without a fight. What are my chances of winning this battle?

Luckily for you, most courts will go in favor of having the child move with the mother.  The only way the father could win the battle is if he makes you look like an unfit mother.  But basically the judge is going to look at who can and will offer your daughter a more stable environment to live in.

It really depends because unless there is any concern for her seeing her dad then they don't usually like reduce contact he might be willing to travel to see her which will get brought up in court. Try not to get into a slagging match with your ex partner as it must be hard for him esp if they have a close relationship they may ask your daughter what she wants as well.
