    I Rented A Home In New Jersey Without Any Lease Or Agreement. Vacated The Home After 3 Months Giving 30 Days Notice. Now Owner Is Not Returning Deposit Back. Can I Get Deposit Back If I Go To Court ?

    The problem is even if you were living month to month you still needed to get that in writing as well as the amount of the deposit and in case of you leaving what amount of that deposit would be returned when you complied by giving 30 day notice. If you had no lease or agreement why do you give 30 day notice? In any state of the union a written contract should be obtained in regards to rental or purchases.

      With nothing on paper, this is a situation for disaster on both parties. Basically, you could of moved in and not given any notice on leaving. If you have nothing in writing, whose to say that your security deposit isn't a cleaning deposit. Haven't you ever watched judge wapner? His words of wisdom were always get a receipt. Yes a lease is the same as a receipt. If, you decide you want to take your chances in court, you've got a 50/50 chance, for everything is word of mouth and its your word against the landlords.       Yes you can get your money back if you gave the proper notice of moving out. But without things in writing, the landlord could claim that you left his property in ruin or that you in fact just moved out. I hope you at least have your rental receipts.
