    Trust beneficiaries hold an equitable interest as tenants in common lest the trust instrument specifies that they are joint tenants. For instance, let us assume that there are three beneficiaries which hold an entire one-third of the equitable title of the trust property. If the parties are tenants in common, then following their deaths, the heirs will legally inherit the shares proportionately. If the parties to the property are joint tenant, then upon the death of an individual who is a partner to the trust, the other two divide the shares proportionately.

    In order to change the title deed from joint owner to tenants in common, all holders of the property must sign a deed stating their interest in property to themselves. Further the deed should specify the interest every owner holds in the property.  The deed should also state that the owners hold title as tenants in common in place of joint tenants. Lastly, the deed must be notified with the recorder of deeds in the place where the property is situated to enable the rightful transfer of the deed title.
