Can We Legally Move Out If Landlord Breaks Lease?

We moved on Dec. 1st and since then we have experienced multiple problems involving attempted break-ins and neighbors smoking crack and having the smell stay in our apartment. Our landlord has failed to evict neighbors our remedy the situation. We stopped payment on the security deposit, as the landlord had not cashed it yet. We would like to move out before the end of the month and end this nightmare.

    If the landlord breaks lease then you are free to go. The only issue will be your security deposit. Normally on the break of the lease the landlord give you 30 day eviction notice. You have to read your agreement about any particular terms about eviction.

    Yes, it is a case of personal endangerment and a case of health hazard and therefore, a probable beach of contract. Since landlord has not cashed check and you stopped payment, no need to worry unless landlord sues you. But if you are armed with break-in police report and witbness to drugs being used and is contaminating you habitat,....no problem!
