In Florida, Can A Landlord Evict A Tenant With A Note From Her In 3 Days?

We have a month to month contract and are only 1 day late on our rent and she taped a typed note from her on our front door saying we had 3 days to pay an unreasonable amount of money or we would have to be out by then.

    Well normally the eviction time period is mentioned on the agreement. If it not determined there, then usually it is determined by the pay day you have. Since you have a month to month contract, then the eviction notice must also be 1 month. If you are late for rent then landlord would have to mention in the notice that you have this much time and you must pay your due rent plus late payment if any to the landlord in that period to avoid eviction. The landlord can not possibly charge anything extra on it.

      It should be stated in the lease what the late payment fee would be and the past due rent amount. I really think she has to go thru the court system to evict you. Go to the county court web page where you live and there should be a tentant rights page that should be able to answer your questions. I also think that it depends on how many times you have been late in the past.  If you can not find the web page call the courts and they can give you the right answer.
