What Penalties Are There For Renting Out A House With A Built In Swimming Pool Without A Fence?

    There are rather few outside swimming pools in the UK, so I assume this must be a question from someone based in the USA.

    In WHICH CASE, you need to say what state you're in, and maybe what city to. Because both state and city ordnances probably come into it.

    From what I can quickly research, only 3 US states (Ohio is one of them) do not operate the "attractive nuisance" rule. Which basically means that if a property has something attractive to children like a swimming pool, the onus is on the property owner and possessor ("tenant")  to protect the child from easily hurting themselves.  So basically, as a landlord, if you didn't fence off the land, you could be liable for getting sued, jointly if not fully.

    In some states/cities the tenant may be assigned greater culpability for the lack of fence or if a fence is ill-maintained or inadequate... but the bottomline is, do you really want this sort of thing on your conscience?  Why not just put up a decent 5 foot high fence with locking gate?

    You won't get landlord's liability insurance without such a fence, anyway.

      Without a fence around a pool, the worst penalty would be the injury or death of someone. It stinks because fences can be so expensive but it's worth it to save a life. Also, it's often required that the airspace between pickets of a pool fence be 3 inches or less and that the gates open out.

      I rent a room and my slidding door goes into the pool area, now i have my grandson over often "you know new family starting out needs babysitter" hes been here for over a year and a half now the owner says he cant come here anymore because of the pool safty issue and i have to moveout if i have him here. Is that legal?
