When in 1935, the Schehter Poultry Corporation were prosecuted for breaking National Recovery Deal's (NRA) codes by selling chickens unfit for human consumption, they appealed to the Supreme Court against the verdict. The nine judges declared the code, the NRA and most of the New Deal agencies illegal, stating that Roosevelt was interfering in issues which concerned the states and not the Federal Government. President Roosevelt claimed the problems created by the Depression were national issues, but it did no good. Due to the "Sick Chicken" cause he therefore had to drop most of his schemes.
Opponents of the New Deal included Francis Townsend, a retired doctor from California. He wanted the Federal government to give $200 a month to every citizen over the age of sixty. The money for this would come from a 2 per cent sales tax. His chances in the election looked very good indeed (supported by Gerald Smith and Father Charles Coughlin).
