    Can A Landlord Raise Your Rent If You Have A Lease And Your Year Is Not Up?

    I am renting an apt in Philadelphia and my lease is not up until next year, however, my landlord is raising my rent $150. Is this legal?

    IN THE STATE OF CALIFORNIA THE IT WORKS IS IF YOU ARE IN ANY TYPE OF LEASE AND THEY RAISE YOUR RENT WHAT THEY HAVE TO DO IS GIVE YOU NOTICE AT LEAST 60 DAYS BEFORE THE END OF YOUR LEASE THET YOU RENT IS GOING UP. IT HAS HAPPENED TO ME 3 TIMES IN THE 3 YEARS I HAVE BEEN HERE HOPE THAT HELPS.

      Read your Lease. If it says he can, he can. Otherwise he cannot and to do so constitutes a breach of teh agreement which means that you would be free to leave without penalty.

      Read the Lease. If the lease has a provision that allows rent increase during the term of the lease than yes, he can. If, however, the lease agreement is silent, then no he cannot and do so would be a breach of the lease releasing you to get another lease without penalty.

      It can not be enforced unless there is a clause in your renter's agreement that says he can do this. Read your agreement carefully and if there isn't a clause that allows him to raise the rent during the lease then send him a registered letter that says you will be paying only the agreed-upon amount and that if he attempts to evict you before the end of your lease he can expect to be sued for breach of contract. Keep a copy of this letter and the receipt from your registered letter. He will back down.
