    I Was Charged Over $800 When I Moved Out, For Them To Replace The Carpet In Living Room, I Want My Deposit Back And Say It's Normal Wear And Tear, They Want Over $800. Is That Legal?

    Is it legal for an apt complex to charge a lot ($800 in my case) and not give me back my deposit, they say it's to replace the living room carpet, and I say it was normal wear and tear and the carpet was too light, it was off white? I want my deposit back and not to pay them.

    This is a touchy situation. I know it sounds like "Monday morning football". Let's back-track for a minute. How long have you lived there ? Do you have dogs or cats that you kept inside ? If "yes", are they house-broken ? How many people dowelled there ?, and have they contributed to the wear and tear traffic ?

    I'm not trying to say "I told you so", but as a renter, you should have gone all through the property within the first 7 to 10 days, and to list ALL problems and observations you noticed, and presented this to your landlord during a walk through. Then the landlord would be given the choice of correcting them then, or leaving them "as is" ... and Both of you initialing each item.

    If there has been a lot of wear and tear, you could take the landlord to a small claims court, and let a judge decide what is reasonable or negligence.
