Is It Legal For Landlord To Withhold A Deposit Based On Breaking A Lease?

My landlord is withholding my deposit because I'm breaking the lease based on that they are illegally renting the place because they do not have a permit to do so and it does not meet building codes in Breckenridge, CO. Do they have the right to do this? What should I do?

    A contract involving illegal activity is never enforceable.  A lease is a contract.  If I were to lease you the Trump Towers (no, I'm not Donald) and you paid me a $500 deposit, you would have every right to have the deposit back as we didn't have a valid contract.

    Be sure to carefully document (take lots of pictures) that you didn't cause any damage to the place as the landlord would have the right - regardless of the lease - to collect from you for damages.  You may have to sue him in small claims court.
