How Long Does A Landlord Have To Give A Tenant Before Making Them Move If Tenant Is Evicted?
I am going to court for non payment of rent and 1 month of security. We are going through a hardship and tried to explain that to landlord and now she is taking us to court. If evicted at this time how long will the judge give us to move if we have children and a one year lease? I read on the landlord tenant rights that the landlord has to give us 60 days notice is that try for New York state?
That would depend on the Landlord/Tenant laws in your jurisdiction. Each state and county has their own rules and regulation for this matter. The best place to start a search for the answer is to contact the Landlord/Tenant section of your county judicial branch of government or request clarification from a legal professional. In most areas, if a tenant is evicted, the local sheriffs dept actually moves the tenants personal belongings to the street curb and the landlord then padlocks/or changes the lock on the door on the day of the scheduled eviction.
