I Am A Salaried Employee Who Typically Works 8 Plus Hours A Day, When I Worked To Cover A Non-salaried Employees Shift I Worked A Six Hour Shift For That Day. My Employer Wants To Reduce My Salary For Not Fulfilling An 8 Hour Shift, IS THIS LEGAL?

    No. You need to remind your employer that 1. Either you are paid by the hour as this person is, in which case if she/he works at a significantly lower rate that you did on average, you can tell your boss that you are more than happy to clock your hours and then for every minute over 8 hours, you start to get either a)comp time, or b) overtime; or 2. You are on a salary, which means that you have obviously had times you have spent over 8 hours there. Tell your boss that again you are happy to calculate exactly how much you go over, but, in that case it will likely go in your favor; or 3. He just realizes that no matter what he got another employee to cover an employee's shift for no more money than just your own salary, which is a deal -- ie. No headhunters, no fees paid to other people, etc. You did this as a favor to your boss, and now he/she is acting in bad faith. Tell him you have been dedicated to the position and that in any case he needs to realize that he has the best of all worlds. You would rather not take it to HR if you don't have to....
