What Happens If A Credit Card Company Sues You?

Answer Question

1 Answer - Sort by: Date | Rating

Credit card companies rarely take people to court, unless they have exhausted every other avenue, such as by sending payment reminders and having a collections agency attempt to make an arrangement with the debtor. Then, given the high cost of litigation, these days, at least, in the USA, it is highly unlikely that debts under a certain amount would go to court. In the event that the credit card company sees fit to do so, however, then you would treat it as you would any other lawsuit, by contacting your attorney, and having him/her do what he/she can for you out of court, which, in most cases, is doing the aforementioned: Settling your debt. However, even if you do so, your credit history would be marred by your debts and non-payments. To avoid this, people should not overextend their credit (i.e., buy only the essentials and only what you can afford to pay back within a three-month period (n.b., since most car dealerships and housing lenders would not accept credit cards, these big ticket items would never appear on your credit card history, but would appear in your credit history, which, obviously, is not limited to just credit card expenditures and debt)).
