What are our resources after they pay rent? If we don't accept it ...... Can they come back and claim refusal of rent? We may never get that money back.

Having no legal titles I can only give opinion. If they pay the rent once you have started legal eviction, we need to know how far behind of rent they were, is this habitual? If they pay, the rent was still owed, so I would think that is your rightful rent money. When you go to court, it will probably be all about dates. If you continue to rent, you need guidelins, laws, a relly good rental agreement. If you started proceedings, I gather it was more than a month's rent they owed, and you apparently do not feel comfortable with the present tenants.
