 What, If Any, Legal Recourse Does My Child Have After Signing A Lease Only To Find Out That It Is For An Illegal Dwelling
My daughter signed a year lease for an apartment that we just found is not a legal dwelling. She has paid every week ($175.00) since 9/07. It was never approved through the county zoning as a legal dwelling (it was a conversion from a garage to an apartment on private property). What, if any retributions is the owner responsible for? Does he have to reimburse her money, is he liable for putting her into a legal dwelling? She has two small children (4 & 7 yrs old) and has no place to go at this time.

 Is the city trying to get involved, or do they know about this place? Is your daughter not wanting to live there? If she has no place to move and the city is not after this person that owns the place then I would just not say anything and keep on living there. If she is just wanting to get money back then I hardly think it would be worth the trouble to cause this person a problem just to gain a few bucks and then make a hardship on myself by not having a place to stay.

 No, the dwelling has been reported to the county by the L/L ex-girlfriend, that is how we found out that it is illegal. He had the county come out and re-inspect the premesis, sign off and then told my daughter it was all taken care of ... only to find out last week that it WAS NOT!! He told my daughter that he did not want to get into any more trouble so now she has to move before he has another re-inspection. my concern is that he has now put my daughter into a position that she has no control over. She would love to stay ... especially since her 7 yo is registered in the school within walking distance. I really dont think it is very fair to take money on a false
pretense from a young mother and her children because the "so-called" landlord knows her limited situation at this time. No, she is not trying to MAKE A BUCK!! She truley is in the middle of the Landlord and his EX just trying to get back at each other!!

 Check into the landlord tenant laws for your area but if it isnt a legal dwelling to start with the there landlord broke the lease from the very start and you should be able to sue for triple damages.
