When Is A Gift Not A Gift Legally?

If you gave a gift and ended up in court,what would the court side with you regarding the gift?

    Once a gift is given, the court looks at it as your property, the receiver that is. You can't take it back in court. Seen this on a few of the shows that I have seen with court issues like this. Hope this helps.

    If you give a gift with stipulations does that still make it a gift and you can't recind it?

    That would totally depend on the stipulations that are attached to the gift, say like, a parent gives you a car, but if you get one ticket in say 2 years, then the car goes back to the parent. Seems fair to me, and in a case like that, the judge would agree, because the giftee made the agreement as well.
