I Would Like To Know How Long Do I Have To Leave When I Am Evicted For Failure To Pay Rent?
I have to leave to take care of my grandmother and have no choice but to break my lease but the owner doesn't wanna break the lease?

Failure to pay the rent on time can result in eviction by the landlord. A three-day notice to "cure or quit" can be given to a tenant who has not paid rent on time. It is a warning that if the rent is not paid within three days you can be taken to court to be evicted.

In any event I'm sure you know that it's wrong to stay any amount of time if your not paying. In the end you will probably be held accountable for at least the time you or your things are there, and maybe around three months after the place is empty and cleaned. In most places, unless the owner can show he had some kind of problem getting a new renter, this is considered reasonable.

If you want to know the real answer, it can vary depending on how you handle the legal paper that are served on you. There are specific timelines for you to file your responses with the court, which you have the legal right to do. If you do not file in a timely manner you will lose your right to file an answer and that will cause the time you have to decrease. One of the best books I've read on this topic is the Tenant/Landlord Handbook and also the Landlord/Tenant Handbook. One is from the view of the tenant, and the other is the view of the landlord. It is good to read both so you can see not only what to do but what they can do to you. The tenant book has timelines, how to answer, file lots of good stuff. P.S. It all depends what state you are in.Here in Texas the property manager will put a 3 day notice to vacate if you do not respond they will then go to the court house and file for eviction,they will be given a court date and one will be sent to you or bought to you by a constable it could take any were from 2 to 3weeks for the court date you will then go before the judge explain the situation and he will then give a time to move out which is usually 5 days to a week if you don't move out by then the manager will have to go back to the courthouse and tell them you aren't out yet and that they are filing a RTD on you.Y should be notified once again to leave the apartment by a certain date and if you aren't out buy that date then the constable will come and stand there while the maintance men throw out all your possessions onto the street and that can be very sad in fact it will be very embarrassing.Now I don't know what your situation is or were you are at but there is a thing called a paupers plea that you can file if there are really sad conditions of why you couldn't pay your rent and why you can't move out so call and find out if there is a paupers plead in your city or state and ask them about it.GOOD LUCK

You have to go by the law in your state but it depends on the judge it's usually 30-60 days
