    Well, the Legal eviction time varies from state to state. However, the standard eviction time period for a tenant paying rent on month to month basis, is 30 days. Thus you would have to give a written notice of 30 days to the tenant to vacate your property.

    I do not agree with this answer. I called the county courthouse and the clerk told me that if the tenant has not paid their rent then I can serve her with a 3 day notice to vacate.
