How Are `assault` And `battery` Different From Each Other?

    Depending on the locality you are in and the rules being followed, there assault and battery could be treated as a single charge or be distinguished as two separate charges. What's the difference? They are both violent crimes. Assault is the threat of some sort of violence whereas battery is actual physical violence that is carried out. Where these two types of crimes are differentiated the latter is considered much more serious then assault, obviously as another person is bodily harmed.

    The intention of the first is squarely to put another person in fear of immediate harm. The violence that is implied is intended and when occurs can be termed as battery. Battery can also involve the use of a deadly weapon. Assault with a deadly weapon is a charge when a deadly weapon is used when threatening harm.
