    Can I Use Up My Deposit To Pay For Rent?

    I just received a 60 day notice to leave my rental, can I use up my deposit money to pay for the rent. I am not being evicted, the lease will terminate Oct 31,2008, and yes I paid a security deposit and first months rent.

    Generally, I'm going to say that no, you can't use your security deposit for last month's rent.  This should be stated in your lease, if not, then you might be able to get away with it.  The purpose of your security deposit, though, is to pay for things that be fixed, replaced, cleaned after you move out.   Your lease may actually contain wording that so much of your security deposit will be used for carpet cleaning, etc., so that you're not entitled to the full amount back.  Also, your landlord is going to want to make sure the apartment is still in good condition when you move out.  Granted, they could still bill you afterwards.

      If it doesn't restrict you in your lease I don't see why you can't use your security deposit to pay for this month's rent.
