    I Married On July 4th Last Year And My Husband Is Moving Out A Week Before Our First Anniversary, Do I Qualify For An Annulment In New York State If I Get The Forms Filed Prior To One Year?

    I see definitions of annulment, is there a specific time frame in t he state of New York from the date of the marriage to the date of spousal desertion? Is it faster to file for a judgement of divorce We have no property together and no children together. I'm not sure if its less expensive to go to a mediator?

    Well, in the state of Newyork, Divorce is pretty easier to get than an Annulment. You have to have exact evidence to support your claim. Annulment is only granted on the basis of the following grounds:
     - Physical disability
     - Underage marriage
     - Insanity of the spouse
    - Forced consent
    - Fraud.
    Unless and until you have any of the above issues with your spouse you are not likely to get an annulment in the state of newyork.
