    How Can I Evict A Tenant Who I Have Never Given A Lease Agreement?

    I allowed relatives to live in my rental property for a nominal amount of rent, which after 3 months, they stopped paying. Now the outstanding debt is 1400 dollars and I never gave them a lease to begin with. Do I proceed with the normal eviction proceedings?

    I would proceed with eviction notification because in affect you gave them a verbal Leese buy telling them they could live in the property for a small amount of rent.However once they stopped paying you rent the verbal lease was broken. A verbal contract still holds up in court. They have to tell the truth wile under oath or risk imprisonment for pergury.After giving them the proper eviction notices though and they still have not moved out you could call the sheriff and have them removed by force. By the way just because you are evicting them dose not under any circumstances relive them of responsibility for the back rent they still have to pay it . If they refuse you could go to court and get a judgement against them so that there income could be garnished by the courts and payed to you until all the back rent is paid in full.

    Thank you....as this is what I somewhat...assumed to be the case. Now I just have to figure out how to do the eviction....from 300 miles away...if that is posssible.
