Can You Help With Object Notice Of Claim?
I moved out from my apartment after 4 years and the landlord sent my a notice of claim to keep my deposit and charge me extra money to change the carpet, repaint the walls and extra cleaning. How can I dispute this?
Answers
There are certain rules that govern the eviction procedure and the tenant and the landlord must follow these rules. First of all, the Landlord can not keep the security deposit like this. You must have sent him a letter for inspection before you moved out. The landlord can make the claims only on those things that he made note on during that visit. Secondly, several things that you have mentioned wear out after four years such as paint carpet etc. The tenant is not responsible to pay for such stuff that generally wears out during his tenancy period. So you have a fair case. Talk to him and if he does not agree, take him to court.
