How would you counter an author who says there's no point in making their protagonists act more like heroes than villains because people are still going to criticize them?

An author is god to his characters -- he can create them any way that suits him. But if he doesn't make them attractive to his readers he'll be writing for himself alone. Waste of time.

Why would you want to? It is the author's story to tell. He or she can make them any way they want. I find conflicted characters more interesting, anyway.

Er, about that. The author insists that his protagonists are heroes in spite of prison abuse, victim blaming, racism, not having trials if there is "more than enough proof", no parole system and running a police state. And they're anything but conflicted, they (and the author) actually think their species can do no wrong.
