In New Jersey, an individual who is caught in possession of under 50 grams of marijuana is charged with a disorderly person offense. Pursuant to the Criminal Code of New Jersey, an individual convicted of this offense faces 6 months of incarceration, fines up to a maximum amount of $1,000, and the loss of driving privileges for a period of 6 months to 2 years. If an individual is caught with more than 50 grams of marijuana, it is considered a fourth-degree criminal offense. A fourth-degree conviction can result in a State Prison sentence of 18 months, up to $25,000 in fines, and the loss of driving privileges for a period of 6 months to 2 years.
