Should a person found guilty of sexual abuse who had also being abused as a child receive a lighter sentence than someone who had not been abused?

I think not. The accused who was also abused as a child knows exactly what kind of damage that abuse can cause and he still willfully chose to inflict that damage on another child. Personally, I'd give him a harder sentence.

I totally agree. Knowing full well the enormous Psychological trauma that is caused by the abuse & still abusing another person is a worse category than someone who did not know. A lot offenders try to hide behind their abuse for various reasons but in sentencing it should not have any mitigating weight. Unfortunately in many cases it does. As many detectives have told me:

"It's not a justice system-It's a legal system".

Great answer Corey!

I wouldn't think that would matter to the victim(s) at all. Nor should it matter to the jury. Do the crime, do the time.

As someone who was raised in a very abisive home, I say that does not give anyone an excuse to commit any form of abuse.

No.

While homicide may be justified in certain instances; I simply cannot imagine that there is ever justification for abusing a child.
